Roger E. Binette is a judge on the Erie County Court of Common Pleas who hears Civil, Criminal, Domestic Relations and Probate cases in Erie County, Ohio. He was first elected to the court in 2004. Binette won re-election to a third consecutive term in the general election on November 8, 2016.[1][2][3]

Biography

Binette received his undergraduate degree from Firelands College in 1986 and his J.D. from the Regent University School of Law in 1991, earning admittance to the Ohio Bar the same year. He held the following positions prior to his election to the court of common pleas in 2004:

  • 1992–2004: Attorney in private practice, specializing in Probate, Domestic Relations, Civil and Business law
  • 1991–1992: Erie County Prosecutor, Erie County, Ohio[1]

Selection method

The 391 judges of the Ohio Courts of Common Pleas are all selected in an identical manner. Qualified individuals wishing to join the bench must participate in partisan primary elections followed by nonpartisan general elections.[4]

The chief judges of the Ohio Courts of Common Pleas are chosen by peer vote and serve for one year.[4]

Qualifications
To serve on an appellate or general jurisdiction court, a judge must be:[4]

  • a district or county resident (for court of appeals and common pleas judges);
  • at least six years practiced in law; and
  • under the age of 70.

Under the Ohio Constitution, a judge who reaches 70 years of age may be assigned by the chief justice to active duty, receiving payment on a per-day basis in addition to whatever retirement benefits he or she is entitled to.
