Abstract
In terms of social policies and services, of labour law and social protection, the allocation of competences has hardly changed since the initial European Community Treaty in 1957. Nonetheless, over the years, the impact of European legal economic freedoms has continued to grow. Its influence on labour legislation and social protection collective arrangements is increasingly highlighted by the caselaw of the Court of Justice. Social services actors in older member-countries are more and more aware of this trend and many of them are worried, particularly in associations. On the other hand, the latter welcome the progress achieved in terms of individual rights due to the will and determination of EMU laws. Hence, the Union's legislation appears double-faced as the ancient god Janus.
