Vacancies

Tennessee Code Title 4, Chapter 3, Part 505 establishes a procedure for filling a vacancy in the office of environment commissioner:

The commissioner is authorized to appoint such deputy and assistant commissioners as may be necessary to discharge the powers and duties of the department. In the event of absence or incapacity of the commissioner or in the event of a vacancy in the office of the commissioner, an appropriate person designated by the governor may be authorized, in accordance with § 4-4-115, to exercise any and all of the powers of the commissioner until such time as the duly appointed commissioner can fulfill such commissioner's responsibilities.[5]

Duties

Title 4, Chapter 3, Part 111 of the Tennessee Code establishes the commissioner of environment and conservation as the chief executive officer of the Tennessee Department of Environment and Conservation:

There shall be a chief executive officer of each of the administrative departments of state government created by § 4-3-101, which shall be as follows:
...
(8) Commissioner of environment and conservation, for the department of environment and conservation;[6]


The department's duties are laid out in Title 4, Chapter 3, Part 504 of the Tennessee Code:

The department of environment and conservation has the power to:
(1) Exercise all functions, rights, powers, and duties vested by law; and
(2) Make rules and regulations not inconsistent with law for the administration of such functions and duties, and for the management of any parks or other properties belonging to the state.[7]

Divisions

Title 4, Chapter 3, Part 503 of the Tennessee Code authorizes the commissioner to establish divisions within the department as he or she sees fit:

The commissioner is authorized to establish divisions, bureaus or other organizational units necessary to carry out the duties imposed upon the commissioner and the department.[8]
