An effort to recall Gary Burke from his position as Dundy County attorney did not go to a vote in 2019. Recall supporters had until August 21, 2019, to submit 200 petition signatures from county residents. They did not submit enough signatures by the deadline.[1][2]

Recall supporters

The recall effort was started by Monica Petersen.[1] The statement of reasons for recall said:

Burke is incompetent as a criminal prosecutor and has failed to fulfill his obligation to go justice in Dundy County. He fails to protect women and children, is unreliable and has no ties to the community. People who commit felonies and high misdemeanors have no fear of being brought to justice in the court system in Dundy County.[3]

Recall opponents

In response to the recall effort, Burke said:

It is disappointing that a resident of Dundy County would choose to use a recall effort as opposed to simply coming in my office to discuss her needs and concerns.

As to the allegations made, I am unable to respond to unsubstantiated rumors or social media drivel concerning my performance as county attorney.[3]

Path to the ballot

To get the recall on the ballot, recall supporters had to turn in recall petitions with signatures from at least 200 registered voters in the county by August 21, 2019. The 200 signatures were equal to 35% of the total votes cast for Dundy County attorney in the last general election.[1] Recall supporters turned in 121 signatures by the deadline, according to Dundy County Clerk Tony Lutz, which was not enough to call for a recall election.[2]
