West Virginia special gubernatorial election, 2011

The West Virginia special gubernatorial election was held on October 4, 2011, following a primary on May 14, 2011.[1] Democratic incumbent Earl Ray Tomblin defeated Republican Bill Maloney, Mountain Party candidate Bob Henry Baber, Independent candidate Marla Ingels, and American Third Position candidate Harry Bertram.
West Virginia was not scheduled to hold a gubernatorial election until 2012. However, elected Democrat Joe Manchin gave up the seat to join the U.S. Senate in the 2010 midterms. Senate President Earl Ray Tomblin, also a Democrat, took over the office as the Lieutenant Governor of West Virginia is a title accorded to the legislator elected as Senate President, and is next in succession to the office of governor.
Multiple lawsuits sought to force a special election in 2011 for the remainder of Manchin's term rather than allow Tomblin to remain in office as an appointee until 2012, and on January 18, 2011, the West Virginia Supreme Court ordered a 2011 election in Citizen Action v. Tomblin - No. 101494.[2]
In the May primary, Earl Ray Tomblin and Bill Maloney easily won the respective Democratic and Republican nominations. The Mountain Party nominated Bob Henry Baber at the convention on the May 1st. Harry Bertram ran as an independent candidate.

Race background
On June 28, 2010, West Virginia's senior Senator Robert Carlyle Byrd passed away. Despite an early opinion from West Virginia's Secretary of State that no special election would be held, the state's attorney general later held that the state could legally hold a special election in 2010. The legislature passed a law setting the election dates and on November 2, 2010, Governor Joe Manchin won the seat.
With the governorship newly vacant, Senate President Earl Ray Tomblin ascended to the office while maintaining his elected state Senate seat and his role as President pro tem of the West Virginia State Senate. Tomblin had hoped to remain as the sitting interim Governor until the scheduled general election in 2012. However, some citizens took issues with his dual role in the executive and legislative branches and sought to force an earlier election.
Citizen Action v. Tomblin
In Citizen Action v. Tomblin, January 2011, the West Virginia Supreme Court unanimously agreed with the petitioners and ordered a 2011 election. Governor Tomblin stated he would abide by the ruling and indicated his preference for a May 14, 2011 primary and an August 6, 2011 general election. On January 19, 2011, 11 delegates introduced HB 2552, which addressed electoral matters for future situations when the governor's seat is vacant.[3] The bill was first referred to the Committee on the Judiciary and later to the Finance Committee.
In the meantime, Governor Tomblin reconsidered election dates. On January 21, 2011, he announced the primary and general election dates.[4] June 20 was chosen in light of "West Virginia Day," a holiday memorializing the day West Virginia entered the Union in 1863.[5]
Within days, both the Democratic and Republican parties had put forth several candidates, some of whom also announced plans to run in the 2012 regular elections. Governor Tomblin was among those seeking the seat in the special election.

Results
Eight Republicans and six Democrats filed by the 5:00 p.m. deadline on February 12, 2011, to appear on the primary ballot on May 14, 2011.[1]
The primary saw far higher turnout for Democratic voters, in a race that Tomblin won easily.[2] Political neophyte Bill Maloney scored an even larger electoral win on the GOP side.

Polls
An exhaustive January 2011 poll by Public Policy Polling found, after comparing the numerous possible combinations, that the GOP's only solid chance to pick up West Virginia in 2011 was in nominating Capito. That avenue, however, closed when she declined to run.[4]
An April 2011 poll by Public Policy Polling, taken after the period to announce a candidacy was closed, still showed the Democrats likely to retain the seat, with any likely Democratic nominee besting any likely Republican primary winner. That poll showed high numbers of undecided voters, meaning both parties have the potential to gain much more ground ahead of the general election.[5]
