Pennsylvania Question 5 was on the ballot as a legislatively referred constitutional amendment in Pennsylvania on November 3, 1981. It was approved.

A "yes" vote supported requiring that proceeds from aviation fuel excise taxes may only be appropriated for purposes related to air navigation, such as construction, operation and maintenance of air navigational facilities, and property tax reimbursement.

Ballot title

The ballot title for Question 5 was as follows:

Shall Article VIII, Section 11, of the Pennsylvania Constitution be amended to provide that net proceeds from aviation fuel excise taxes be appropriated by the General Assembly to State agencies or political subdivisions to be used solely for purposes related to air navigation including, but not limited to, construction, operation and maintenance of air navigational facilities; property tax reimbursement; and further providing that these proceeds shall not be diverted by transfer or otherwise to any other purpose?


Path to the ballot

In Pennsylvania, the General Assembly must pass a constitutional amendment by a simple majority vote during two successive legislative sessions to refer the measure to the ballot for voter consideration. The legislature can also pass a measure by a two-thirds vote during one legislative session if a “major emergency threatens or is about to threaten the Commonwealth.”
