The New York Attorney General election of 2010 was held on November 2, 2010. Incumbent Andrew Cuomo accepted the Democratic nomination for governor, leaving the attorney general seat open.

Democratic State Sen. Eric Schneiderman defeated Republican Dan Donovan and two minor-party candidates in the race to replace Cuomo.

Noteworthy events

Comptroller donations

In late-June 2010, the New York Daily News said Coffey and his former law firm, Bernstein Litowitz Berger & Grossmann, donated as much as "$112,000 to the past three state controllers" at the same time they had been "hired to represent the pension fund in three major class-action suits."Executive director of Common Cause New York, Susan Lerner, said, "It raises all sorts of questions about pay-to-play politics."[132]

Coffey said that the firm supported people who shared their views about aggressively pursuing corporate misconduct."I didn't make my money because of Campaign contributions," Coffey said.[133]

Rice campaign donation

Kathleen Rice received a campaign donation from a company under investigation by incumbent Andrew Cuomo's office. According to an article published by the New York Daily News, Rice "received the maximum campaign contribution of $55,900 from Steven Napolitano, who heads a wholly-owned subsidiary of First American Corp."[134] First American Corporation was sued by the attorney general's office in November 2007.

Cuomo had also accepted nearly $136,000 in campaign contributions from executives of First American Title Insurance Company of New York, a subsidiary of First American. The subsidiary's president, Steven Napolitano, gave $106,000 of those donations from January 2009 to May 2010.[135]

A spokesperson for the Rice campaign said, "She's not the attorney general, so she's obviously not in any position to judge the circumstances surrounding his issue with the office, nor does he have any business with the Nassau DA's office".[136]

Schneiderman car accident

On Tuesday, July 13, 2010, Schneiderman was involved in a car accident in Manhattan. The Huffington Post said the Democratic state senator "was in a car driven by a staff member (Rachel Kagan, niece of United States Supreme Court Justice, Elena Kagan) when it hit a parked car Monday night and drove away".[137] The owner of the vehicle filed a police report and traced the license plate number to contact Schneiderman's office.

A spokesperson for the state senator said, “For New York 1 to call this a ‘hit and run’ is nothing short of outrageous,” and “He has spoken with the owner of the other vehicle, expressed his sincere apology and offered to pay for all repairs."[138]

Candidates' legislative attendance

Eric Schneiderman did not miss any days of the 2009 legislative session. In the 2010 session, he was absent or excused for six out of the eighty days the upper house was convened.[139]

Democratic Party primary candidate Richard Brodsky had 24 absences during the 2010 session of the New York Assembly.[139]
