These Regulations govern the student loan liability of students who receive loans for living costs from the Welsh Ministers in respect of the academic year 2014/2015.

This Order appoints Bangor Diocesan Trust as trustee of the endowment of the educational foundation known as the Llangristiolus School Foundation (formerly known as Henblas School, Henblas Old School, Hen Ysgol and Llangristiolus Primary School) and makes new provision as to the use of that endowment. It creates two separate trusts, called the School Fund and the Religious Education Fund, and divides the Foundation’s assets between them.

These Regulations prescribe the time and manner of publication, and content of draft proposals for the dissolution of further education corporations. The Regulations also provide detail on the consultation process that must be followed, as well as prescribing the bodies to which a further education corporation can transfer its property, rights and liabilities upon dissolution.

Sections 32A to 32C were inserted into the Education Act 2002 by section 42 of the Education (Wales) Act 2014 and make provision in relation to fixing school term dates and school sessions for maintained schools in Wales.

The Learning and Skills (Wales) Measure 2009 (nawm 1) inserted new provisions into Part 7 of the Education Act 2002. Part 7 concerns the curriculum in maintained schools in Wales. As a result of Part 1 of the Measure the curriculum in maintained secondary schools in Wales is expanded to include the local curriculum entitlements of pupils in key stage 4.

The foundation phase was introduced on 1 August 2008 by the Education (National Curriculum) (Foundation Stage) (Wales) Order 2008 (“the 2008 Order”). The 2008 Order also specified the period of the foundation phase and gave legal effect to areas of learning, which set out the desirable outcomes and educational programmes.

Section 32A(3) to (4) of the 2002 Act requires local authorities and governing bodies of foundation and voluntary aided schools to co-operate and co-ordinate with each to other to ensure that school term dates are the same (or as similar as can be).

These Regulations, which come into force on 31 October 2014, require local authorities to establish management committees to run pupil referral units (PRUs) in their area, and make provision for the constitution and procedures of such committees.

These Regulations apply to governing bodies of maintained schools. They impose a duty on the governing body to draw up a school development plan in order to assist it to exercise its responsibility for conducting a maintained school with a view to promoting high standards of educational achievement (regulation 3). That duty does not affect the general principles and respective roles and responsibilities of governing bodies and head teachers set out in the School Government (Terms of Reference) (Wales) Regulations 2000 (regulation 3(2)). The content of the plan is set out in the Schedule (regulation 4).

This Order identifies a small maintained school for the purposes of Chapter 1 of Part 2 of the Education (Wales) Measure 2011 (“the 2011 Measure”). That chapter sets out the statutory framework for the federation of maintained schools. Section 11 of the 2011 Measure provides that a local authority may make proposals to federate schools and that certain provisions relating to publication and consultation do not apply to a proposal to federate only small schools.

The Education (Student Support) (Wales) Regulations 2013 (“the 2013 Regulations”) provide for financial support for students who are ordinarily resident in Wales and taking designated higher education courses in respect of academic years beginning on or after 1 September 2014.

This is the first commencement order made by the Welsh Ministers under the Education (Wales) Act 2014 (“the 2014 Act”). The Order brings sections 42 and 48 (partially) of, and paragraph 1(1), (2) and (6) of Schedule 3 to, the 2014 Act into force on 14 July 2014. Those sections make provision in relation to the setting of term and holiday dates and times of school sessions. The effect of those provisions commencing on 14 July 2014 is that the first term dates which local authorities and the governing bodies of voluntary aided and foundation schools have determined and which must be notified to the Welsh Ministers by local authorities are for the school year 2016/2017.

The Education (Wales) Measure 2009 (Pilot) Regulations 2012 (“the 2012 Regulations”) make provision to pilot the provisions of the Education Act 1996 (on special educational needs appeals) and the Equality Act 2010 (on disability discrimination claims) as amended by Part 1 of the Education (Wales) Measure 2009 (“the Measure”). The effect of the 2012 Regulations, combined with the provisions in the Education (Wales) Measure 2009 (Commencement No. 3 and Transitional Provisions) Order 2012 (“the Commencement Order”) is that the amendments made by Part 1 of the Measure to the Education Act 1996 and the Equality Act 2010 apply only for the purposes of piloting in the local authority areas of Carmarthenshire and Wrexham.

The Order brings Chapter 1 of Part 2 of the 2011 Measure into force on 28 April 2014. Chapter 1 of Part 2 of the 2011 Measure makes provision about the federation of maintained schools.

Section 2 in Part 2 of the Education (Wales) Act 2014 provides that the General Teaching Council for Wales is to continue to exist but will change its name to the Education Workforce Council (“the Council”). Part 2 makes further provision in relation to the Council. These Regulations make provision in relation to membership of the Council and the appointment of the chief officer and they come into force on 29 September 2014 except for those provisions in regulation 2 which come into force on 1 April 2015 when it is anticipated that the Council will be fully operational.
