This Order is the third Commencement Order made by the Welsh Ministers under the Apprenticeships, Skills, Children and Learning Act 2009 (“the 2009 Act”), which brings specified provisions of the 2009 Act into force so far as relating to Wales.

These Regulations provide for financial support for eligible students ordinarily resident in Wales undertaking postgraduate courses at the Bologna Center and the College of Europe. The Regulations apply in respect of academic years beginning on or after 1 September 2011.

This Order dissolves the further education corporations established to conduct Barry College (“Coleg y Barri”) and Coleg Glan Hafren with effect from 1 August 2011. It provides for the transfer of the property, rights and liabilities of each corporation to Cardiff and Vale College Further Education Corporation (“Corfforaeth Addysg Bellach Coleg Caerdydd a'r Fro”) and secures the employment rights of the employees of the dissolved corporations by applying, with modifications, section 26(2) to (4) of the Further and Higher Education Act 1992 (“the Act”).

These Regulations govern the student loan liability of students who receive loans for living costs from the Welsh Ministers in respect of the academic year 2011/2012.

This Order establishes a further education corporation called “Cardiff and Vale College” under section 16(1)(a) of the Further and Higher Education Act 1992 (“the Act”) for the purpose of conducting the educational institution of the same name. The Order also provides for the appointment of 1 August 2011 as the operative date for the purposes of Part 1 of the Act, being the date from which Cardiff and Vale College is to conduct the educational institution of the same name.

These Regulations prescribe the Instrument of Government and Articles of Government for Cardiff and Vale College Further Education Corporation. The Instrument of Government and Articles of Government provide for the constitution and conduct of Cardiff and Vale College Further Education Corporation.

These Regulations amend the Education (Information About Individual Pupils) (Wales) Regulations 2007 (“the 2007 Regulations”). The 2007 Regulations require the governing body of any maintained school on receiving a written request from the local authority by which the school is maintained to supply within fourteen days such of the information as is requested by the authority in respect of pupils at the school.

The Learning and Skills (Wales) Measure 2009 (“the Measure”) inserted new provisions into Part 2 of the Learning and Skills Act 2000 (“the 2000 Act”). Part 2 of the 2000 Act concerns school sixth forms and further education institutions in Wales. As a result of Part 2 of the Measure the curriculum in school sixth forms and institutions in the further education sector in Wales, are expanded to include the local curriculum entitlements of pupils who have ceased to be of compulsory school age, but who have not yet attained the age of 19. These Regulations make provision as to the elections a student may make, the head teacher’s or principal’s decision as to entitlement, the determination of a pupil’s relevant school or institution and the head teacher’s or principal’s decision to remove an entitlement.

These Regulations amend the Education (Remission of Charges Relating to Residential Trips) (Wales) Regulations 2003 to add an additional benefit or allowance which entitles the child of a claimant to free board and lodging on a residential trip.

The Education (School Day and School Year) (Wales) Regulations 2003 (“the 2003 Regulations”) apply to schools maintained by local authorities and to special schools (whether or not so maintained). They make provision (among other things) for a school day which is ordinarily to be divided into two sessions (with a break in the middle), and for schools (other than nursery schools) to meet for at least 380 sessions during any school year.

This Order brings into force on 1 September 2011 provisions of the Education Act 2002 specified in article 2 of the Order. These are the provisions that relate to the federation of schools.

The General Teaching Council for Wales (Disciplinary Functions) Regulations 2001 make provision about the disciplinary functions of the General Teaching Council for Wales. These Regulations amend the 2001 Regulations by replacing regulation 8 which makes provision about the membership and procedure of the Investigating Committees, Professional Conduct Committees and Professional Competence Committees of the Council. The new regulation 8 provides that a member of the Council cannot be a member of any of those Committees.

These Regulations make provision as to the report the head teacher is required to send to parents and adult pupils each school year (regulation 3 and the Schedule) and the additional information parents of registered pupils who are assessed in any key stage may request relating to the pupil’s levels of achievements in relevant subjects (regulation 4). These Regulations replace with changes provisions relating to head teacher’s reports to parents and adult pupils formerly contained in the Education (Pupil Information) (Wales) Regulations 2004 (“the 2004 Regulations”) as amended. The other provisions of the 2004 Regulations have been revoked and replaced by the Pupil Information (Wales) Regulations 2011.

These Regulations amend the Head Teachers' Qualifications and Registration (Wales) Regulations 2005 by altering the definition of “The National Professional Qualification for Headship in Wales” in regulation 3(2) of those regulations. The requirements of the “National Professional Qualification for Headship in Wales” will change from completion of a course of training approved by the Welsh Ministers to the fulfilment of certain standards approved by the Welsh Ministers.
