These Regulations are made under powers conferred by section 140 of the Environmental Protection Act 1990 and they amend the Environmental Protection (Single-use Vapes) (Wales) Regulations 2024 (“the principal Regulations”).

These Regulations bring into force specified provisions of the Environment Act 2021 (c. 30) (“the Act”). These are the third commencement regulations made under the Act.

These Regulations, which apply in Wales, prohibit the supply of single-use vapes. They are made under powers conferred by section 140 of the Environmental Protection Act 1990 (“the 1990 Act”) and section 62 of the Regulatory Enforcement and Sanctions Act 2008 (“the 2008 Act”). The 1990 Act allows the Welsh Ministers to prohibit the use, supply, and storage of specified articles to prevent them from causing pollution of the environment and harm to the health of animals. It also allows them to confer powers corresponding to those under section 108 of the Environment Act 1995 on authorised persons, including powers of entry, examination, and investigation, for taking photographs and samples, and the search and seizure of documents. The 2008 Act allows the Welsh Ministers, when making secondary legislation creating a criminal offence, to make any provision which could be made under Part 3 of the 2008 Act. This includes the imposition of the following civil sanctions: fixed monetary penalties, variable monetary penalties, compliance notices, non-compliance penalties, stop notices and enforcement undertakings.
Mae’r Rheoliadau hyn, sy’n gymwys yng Nghymru, yn gwahardd cyflenwi fêps untro. Maent wedi eu gwneud o dan bwerau a roddir gan adran 140 o Ddeddf Diogelu’r Amgylchedd 1990 (“Deddf 1990”) ac adran 62 o Ddeddf Gorfodi Rheoleiddiol a Sancsiynau 2008 (“Deddf 2008”). These Regulations amend the Packaging Waste (Data Collection and Reporting) (Wales) Regulations 2023 (“the principal Regulations”). The purpose of these Regulations is to clarify the division of responsibilities between brand owners, packers/fillers, importers and first UK owners and distributors, and to place a requirement upon Natural Resources Wales (“NRW”) to produce guidance in respect of household packaging and to publish a list of large producers. These Regulations also provide a number of miscellaneous amendments including clarification of sentences and amendment of typographical errors.
Mae’r Rheoliadau hyn yn diwygio Rheoliadau Gwastraff Pecynwaith (Casglu ac Adrodd am Ddata) (Cymru) 2023 (“y prif Reoliadau”). Diben y Rheoliadau hyn yw egluro’r rhaniad cyfrifoldebau rhwng perchnogion brand, pacwyr/llanwyr, mewnforwyr a pherchnogion cyntaf yn y DU a dosbarthwyr, a gosod gofyniad ar Gyfoeth Naturiol Cymru (“CNC”) i lunio canllawiau mewn cysylltiad â phecynwaith cartref a chyhoeddi rhestr o gynhyrchwyr mawr. Mae’r Rheoliadau hyn hefyd yn darparu nifer o ddiwygiadau amrywiol, gan gynnwys egluro brawddegau a diwygio gwallau teipograffyddol.
This Order makes provision in relation to the prohibition on the disposal of food waste to sewer under section 34D of the Environmental Protection Act 1990 (as inserted by section 66(1) of the Environment (Wales) Act 2016 (anaw 3)). Breach of this prohibition is an offence under section 34D(3) of the Environmental Protection Act 1990 (c. 43).
Mae’r Gorchymyn hwn yn gwneud darpariaeth mewn perthynas â gwahardd gwaredu gwastraff bwyd i garthffos o dan adran 34D o Ddeddf Diogelu’r Amgylchedd 1990 (fel y’i mewnosodwyd gan adran 66(1) o Ddeddf yr Amgylchedd (Cymru) 2016 (dccc 3)). Mae torri’r gwaharddiad hwn yn drosedd o dan adran 34D(3) o Ddeddf Diogelu’r Amgylchedd 1990 (p. 43).
These Regulations set out the separation requirements in Wales for the purposes of section 45AA of the Environmental Protection Act 1990 (c. 43) with the aim of ensuring that waste is managed in a manner that promotes high quality recycling. The separation requirements apply in respect of all premises other than domestic properties and caravans.
Mae’r Rheoliadau hyn yn nodi’r gofynion gwahanu yng Nghymru at ddibenion adran 45AA o Ddeddf Diogelu’r Amgylchedd 1990 (p. 43) gyda’r nod o sicrhau bod gwastraff yn cael ei reoli mewn modd sy’n hyrwyddo ailgylchu o safon uchel. Mae’r gofynion gwahanu yn gymwys mewn cysylltiad â phob mangre ac eithrio eiddo domestig a charafannau.
These Regulations prohibit the incineration, or the deposit in landfill, of specified types of waste. The types of waste are food, small electrical and electronic equipment, card, cartons, and certain textiles. The prohibition is achieved by adding specified types of waste to Schedule 9, Part 4, paragraph 1 (waste separately collected for preparing for re-use and recycling not to be incinerated) and Schedule 10, paragraph 5A (waste separately collected for preparing for re-use and recycling not to be landfilled) to the Environmental Permitting (England and Wales) Regulations 2016 (S.I. 2016/1154). In addition to this, there will be a prohibition on the deposit in landfill of waste wood (whether or not separately collected).

These Regulations are made under section 17 of the Environmental Protection (Single-use Plastic Products) (Wales) Act 2023. They enable a local authority, as regulator, to impose civil sanctions in relation to the offence under section 5 of that Act.

These Regulations impose requirements on producers who are established in Wales to collect data on the packaging they supply to others, and, in some cases, to report some of that information to Natural Resources Wales.

These Regulations amend section 11A of the National Parks and Access to the Countryside Act 1949 (c. 97) (“the 1949 Act”). Section 11A(2) provides that when exercising or performing any function in relation to, or affecting, land in any National Park, a “relevant authority” must have regard to the purposes specified in section 5(1) of the 1949 Act.

These Regulations amend section 85 of the Countryside and Rights of Way Act 2000 (c. 37). Section 85(1) provides that when exercising or performing any function in relation to, or affecting, an area of outstanding natural beauty a “relevant authority” shall have regard to the purposes of conserving and enhancing the natural beauty of the area.

Mae adran 85(1) yn darparu, wrth arfer neu gyflawni unrhyw swyddogaeth mewn perthynas ag ardal o harddwch naturiol eithriadol, neu sy’n effeithio ar ardal o’r fath, bod rhaid i “relevant authority” roi sylw i’r dibenion o gadw a gwella harddwch naturiol yr ardal.
These Regulations amend section 6 of the Environment (Wales) Act 2016 (anaw 3) to include corporate joint committees within the definition of “public authority” in subsection (9) of that section, so that corporate joint committees are subject to the biodiversity and resilience of ecosystems duty (“the biodiversity duty”). As a result of these Regulations, corporate joint committees will be required to consider the Nature Recovery Action Plan for Wales when making decisions.

These Regulations amend the Producer Responsibility Obligations (Packaging Waste) Regulations 2007 (S.I. 2007/871) in relation to Wales. Those Regulations impose on producers the obligation to recover and recycle packaging waste in order to attain the recovery and recycling targets set out in Article 6(1) of European Parliament and Council Directive 94/62/EC on packaging and packaging waste (OJ No L 365, 31.12.94, p. 10).
Mae’r Rheoliadau hyn yn diwygio Rheoliadau Rhwymedigaethau Cyfrifoldeb Cynhyrchwyr (Gwastraff Deunydd Pacio) 2007 (O.S. 2007/871) o ran Cymru.
