For the purposes of the Act, a “public authority” includes a body or office which is designated by an order under section 5 of the Act. Section 5(1)(a) of the Act provides that the Secretary of State may, subject to certain limitations, by order designate as a public authority for the purposes of the Act a person who appears to the Secretary of State to exercise functions of a public nature. http://www.legislation.gov.uk/id/uksi/2015/587 The Protection of Freedoms Act 2012 (Commencement No.11) Order 2015 2023-04-24T11:14:36+01:00 2015-03-11T01:16:08.729+01:00 This Order brings into force section 105 of the Protection of Freedoms Act 2012 (‘the 2012 Act’) on 16th March 2015. Section 105 of the 2012 Act makes provision relating to the appointment and tenure of the Information Commissioner. In particular, section 105 of the 2012 Act increases the maximum term of appointment for an Information Commissioner from 5 years to 7 years, amends the procedure for removing an Information Commissioner from office, and prohibits the re-appointment of an Information Commissioner for a further term of office. The Order also commences minor consequential repeals relating to section 105 of the 2012 Act and commences the repeal of spent transitional provisions in section 18 of the Freedom of Information Act 2000.
