These Regulations create an exclusion from Chapter 3 of Part 3 of the Consumer Rights Act 2015 (“the 2015 Act”) which is applicable to legal professionals in certain circumstances.

This Order revokes the Housing (Wales) Act 2014 (Commencement No. 7) Order 2016 and brings into force, those provisions listed in article 2 on 23 November 2016.

Article 2 of this Order amends Schedule 2A to the Housing Act 1985. Schedule 2A lists the serious offences relating to the absolute grounds for possession for anti-social behaviour provided for by section 84A of the Housing Act 1985 (secure tenancies), and ground 7A of Part 1 of Schedule 2 to the Housing Act 1988 (assured tenancies). Sections 1 and 2 of the Modern Slavery Act 2015 introduce offences relating to slavery, servitude and forced or compulsory labour, and human trafficking respectively. This Order adds these offences to Schedule 2A to the Housing Act 1985.

These Regulations supplement the provisions of sections 32 and 33 of the Housing (Wales) Act 2014 (“the Act”). Those sections deal with rent repayment orders. In particular, they deal with the making of rent repayment orders by a residential property tribunal (“the tribunal”) on the application of a licensing authority, a local housing authority (“the authority”) or a tenant of a dwelling.

This Order is the first commencement order made by the Welsh Ministers under the Renting Homes (Wales) Act 2016 (“the Act”). This Order commences certain provisions of the Act on 5 August 2016 for the purposes of making regulations and issuing guidance.
