Article 2 of this Order amends section 160A(8) of the Housing Act 1996 (“the 1996 Act”) by inserting a reference to a new section 84A of the Housing Act 1985 (“the 1985 Act”).

Section 40(1) of the Housing (Wales) Act 2014 (“the Act”) provides that the Welsh Ministers must issue a code of practice setting standards relating to letting and managing rental properties. Once approved by the National Assembly for Wales (“the Assembly”) under section 40(6) of the 2014 Act, the code comes into force on a date appointed by order of the Welsh Ministers.

This Order revokes the Consumer Rights Act 2015 (Commencement No. 2) (Wales) Order 2015 and brings into force, on 23 November 2015, Chapter 3 of Part 3 (miscellaneous and general) of the Consumer Rights Act 2015 (“the Act”) for remaining purposes. This Order therefore brings into force on 23 November 2015 those provisions of the Act which are not already in force.

These Regulations, which apply in relation to Wales, increase the maximum and minimum amounts of home loss payments payable under the Land Compensation Act 1973 (“the Act”) to those with an owner’s interest in a dwelling. These Regulations also increase the amount of home loss payment payable in any other case.

Section 78(2) of the Housing (Wales) Act 2014 (“the Act”) provides that when assessing an applicant for help with homelessness, a local housing authority may not have regard to whether or not an applicant has become homeless intentionally for the purposes of sections 68 and 75, unless it has decided to have regard to one or more of the categories of applicants specified by the Welsh Ministers. Section 78(1) of the Act places an obligation on the Welsh Ministers to make regulations to specify such categories.

These Regulations make provision about the procedure to be followed under section 85 of the Housing (Wales) Act 2014 (“the 2014 Act”) in connection with a review by a local housing authority of specific decisions relating to homelessness.

When discharging a housing function to secure that accommodation is available for an applicant who is homeless, or threatened with homelessness, under Part 2 (Homelessness) of the Housing (Wales) Act 2014 (“the 2014 Act”), a local housing authority (“authority”) must ensure that the accommodation is suitable. Section 59 of the 2014 Act (suitability of accommodation) specifies certain matters to be taken into account when determining suitability for the purposes of Part 2 of the 2014 Act.

This Order amends the existing maximum rates of discount available in relation to the exercise of the right to buy under Part 5 of the Housing Act 1985 (“the 1985 Act”) and the right to acquire under section 16 of the Housing Act 1996 (“the 1996 Act”).

These Regulations amend the Housing (Right to Buy) (Prescribed Forms) (Wales) Regulations 2015 (“the 2015 Regulations”) which prescribe the form of certain notices under Part 5 of the Housing Act 1985 (“the Act”) relating to the right to buy, and the particulars to be contained in those notices. The amendment relates to the prescribed form to be used by a secure tenant claiming to exercise the right to buy in accordance with section 122 of the Act.

The Order also makes transitory, transitional and saving provisions as a result of the commencement of Part 2.

This Order brings into force, on 23 November 2015, certain provisions of Part 1 of the Housing (Wales) Act 2014 (“the Act”). Part 1 of the Act relates to the regulation of private rented housing. Part 1 includes a requirement, which is subject to exceptions, for landlords of dwellings let, or to be let, under domestic tenancies, to register with the designated licensing authority. Similarly, agents of landlords and landlords who are engaged in letting or managing such dwellings are required to apply to the licensing authority for a licence.

Regulation 2 of these Regulations makes consequential amendments to article 3 of, and Schedule 2 to, the Local Authorities (Contracting Out of Allocation of Housing and Homelessness Functions) Order 1996 (“the 1996 Order”). These amendments are consequential upon the implementation of Part 2 of the Housing (Wales) Act 2014 (“the 2014 Act”).

These Regulations set out the information, periods and fees required for an application for registration and an application for a licence under Part 1 of the Housing (Wales) Act 2014 (“the Act”).

These Regulations provide that a licensing authority (which has been designated under Part 1 of the Housing (Wales) Act 2014 (“the Act”)) may authorise a training provider and approve a training course for purposes of delivering training. A landlord or a person acting on behalf of a landlord will need to be licensed in order to carry out lettings and/or property management activities unless exempted under the Act.

These Regulations amend the Residential Property Tribunal Procedures and Fees (Wales) Regulations 2012 (“the Principal Regulations”) in light of sections 17(4) and 27(1) of the Housing (Wales) Act 2014 (“the 2014 Act”) and the Consumer Rights Act 2015 (“the 2015 Act”). The Principal Regulations are amended to include provision in respect of new appeals which may be made to a residential property tribunal under the 2014 Act and the 2015 Act.

These Regulations bring into force, on 1 October 2015, sections 35 and 36 of the Small Business, Enterprise and Employment Act 2015 (“the Act”). Those sections in Part 2 (Regulatory reform) of the Act amend Part 2 of the Landlord and Tenant Act 1954.
