These Regulations give effect, in relation to Wales, to Commission Implementing Regulation (EU) No 543/2011 of 7 June 2011 laying down detailed rules for the application of Council Regulation (EC) No 1234/2007 in respect of the fruit and vegetables and processed fruit and vegetables sectors (OJ No L 157, 15.6.2011, p.1) “the Commission Implementing Regulation 543/2011”.

These Regulations give a housing authority which is a landlord of a flat under a long lease the power to purchase an equitable interest in the flat in order to assist the tenant to meet some or all of the costs of service charge payments payable by the tenant to the landlord in respect of repairs and improvement contributions. The agreement of the tenant is required. The terms “housing authority” and “long lease” are defined in section 458 of the Housing Act 1985. Section 450D of that Act (under which these Regulations are made) modifies the definition of “housing authority”, and defines “improvement contribution” and “repairs”.

These Regulations amend the Housing (Service Charge Loans) Regulations 1992 (“the 1992 Regulations”) which provide for housing authorities to make loans to their tenants in respect of service charges for repairs or improvements. The amendments which apply only in relation to Wales, relate to loans made under the discretionary power in regulation 5 of the 1992 Regulations. That power may be exercised, in respect of flats, by “housing authorities”. The term “housing authority” for the purposes of these amendments is defined in section 450B(4) of the Housing Act 1985.

Mae'r Rheoliadau hyn yn diwygio Rheoliadau Tai (Benthyciadau Ffioedd Gwasanaeth) 1992 (“Rheoliadau 1992”) sy'n darparu bod awdurdodau tai yn cael gwneud benthyciadau i'w tenantiaid mewn cysylltiad â ffioedd gwasanaeth am atgyweiriadau neu welliannau. This Order, made by the Welsh Ministers, commences the majority of Part 2 (Registered Social Landlords) of the Housing (Wales) Measure 2011 (“the Measure”) on 18 October 2011 (“the first commencement date”) with the remainder coming into force on 2 December 2011 (“the second commencement date”).

This Order is the second Commencement Order made by the Welsh Ministers under the Housing and Regeneration Act 2008 (“the 2008 Act”). It brings section 309 (Former right to buy and other flats: equity share purchases) of the 2008 Act into force on 26 July 2011 for the purpose of enabling the Welsh Ministers to make regulations. The Order brings section 308 (Former right to buy and other flats: service charge loans) of the 2008 Act and section 309 fully into force in relation to Wales on 19 August 2011.

These Regulations revoke in relation to Wales the Housing Renewal Grants (Prescribed Form and Particulars) Regulations 1996 (S.I. 1996/2891) and the Housing Renewal Grants (Prescribed Form and Particulars) (Welsh Form and Particulars) Regulations 1998 (S.I. 1998/1113). The 1996 and 1998 Regulations prescribed an English and Welsh form for applications for grants under Chapter 1 of Part 1 of the Housing Grants, Construction and Regeneration Act 1996 (for assistance from local housing authorities to the cost of works required for the provision of facilities for disabled persons in certain dwellings).
