These Regulations define “qualifying arrangements”, referred to in section 105 of the Learning and Skills Act 2000 and provide for payment of grants to persons who are parties to qualifying arrangements (such persons being defined in the Regulations as “individual learning account holders”).

These regulations provide that no qualified teachers, save for certain exceptions, are to be employed in maintained schools or in non-maintained special schools unless they are registered by the General Teaching Council for Wales.

These Regulations make provision with regard to services provided by those whose employment as a teacher or worker with children or young persons is prohibited or restricted under Regulations made under section 218(6) of the Education Reform Act 1988. They also make provision requiring the employers of teachers to report misconduct to the National Assembly for Wales.

The Education (Mathematics and Science Teacher Training Incentive) (Wales) Regulations 1999 provided for the payment of grants by way of incentives to encourage more people to undergo college-based post-graduate teacher training courses to teach mathematics or science at secondary level. The 1999 Regulations are revoked by the present Regulations save in the case of those who have already received a payment of grant under the 1999 Regulations before 22nd September 2000.

This Order brings the provisions of the Learning and Skills Act 2000 specified in the Schedule into force on 19th September 2000.

Paragraph 13 of Schedule 10 to The Learning and Skills Act 2000 provides that the National Assembly for Wales may by order confer powers on the National Council for Education and Training for Wales if it is established before it acquires its full functions, to help it carry out its full functions when it acquires them.

Under section 41(1)(b) of the School Standards and Framework Act 1998 the governing body of a community, voluntary controlled or community special school are responsible for determining the times of the school sessions. That is to say, the times at which each of the school sessions (or, if there is only one, the school session) is to begin and end on any day.

A “modern foreign language” is a National Curriculum foundation subject in Wales in relation to the third key stage. Those languages which are to count as modern languages for the purposes of the National Curriculum are required to be specified in an Order made by the National Assembly, or, alternatively, such an Order may provide that any modern foreign language is a modern foreign language for such purposes.

These Regulations relate to the functions of the General Teaching Council for Wales, a body corporate established by the General Teaching Council for Wales Order 1998, made under the Teaching and Higher Education Act 1998, section 8. The aims of the Council are to contribute to improving the standards of teaching and the quality of learning and to maintain and improve the standards of professional conduct amongst teachers in the public interest.

This Order confers additional functions on the General Teaching Council for Wales, a body corporate established by the General Teaching Council for Wales Order 1998, made under the Teaching and Higher Education Act 1998, section 8. The Council’s functions under the 1998 Act include establishing and maintaining a register of teachers, issuing a Code of Practice laying down the standards of professional conduct and practice expected of registered teachers, exercising disciplinary powers in relation to registered teachers and persons applying for registration and giving advice about teaching issues to the National Assembly for Wales and others.

These Regulations amend the Education (Assisted Places) (Incidental Expenses) Regulations 1997 (“the 1997 Regulations”) in respect of a school year beginning on or after 1st September 2000. The 1997 Regulations provide for the payment of grants as regards incidental expenses, and for the remission of incidental expenses, in respect of pupils eligible to continue to hold assisted places at independent schools by virtue of section 2 of the Education (Schools) Act 1997, notwithstanding the abolition of the assisted places scheme by section 1 of that Act.

Section 354 of the Education Act 1996 lists the subjects which are foundation subjects for the purposes of the National Curriculum. For pupils at Key Stage 3 (broadly Years 7-9), one of the foundation subjects listed in the section is a modern foreign language specified in an Order of the National Assembly. This Order amends section 354 so that modern foreign languages need no longer be specified in an Order under that section. Instead, the Order may provide that any modern foreign language is to constitute a modern foreign language for the purposes of the National Curriculum.

These Regulations specify the information about local education authorities' (LEAs) expenditure on education which must be contained in a statement (referred to in the regulations as an “outturn statement”) which each LEA is required to prepare after the end of each financial year under section 52(2) of the School Standards and Framework Act 1998 (regulation 5).
