The Secretary of State, in exercise of the powers conferred upon her by section 153(4) of the Environmental Protection Act 1990

1990 c. 43; the relevant functions of the Secretary of State insofar as they relate to Scotland were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46). In relation to Wales, the Secretary of State has concurrent powers with the National Assembly for Wales (see article 2 of, and the entry relating to the Environmental Protection Act 1990 in Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672)).
