It enables the Secretary of State, with the consent of the Treasury, to give financial assistance to, or for the purposes of, the Bio-energy Infrastructure Scheme. It extends to England, Wales and Northern Ireland only. 2005 No. 1805 ENVIRONMENTAL PROTECTION, ENGLAND AND WALES ENVIRONMENTAL PROTECTION, NORTHERN IRELAND The Financial Assistance for Environmental Purposes Order 2005 Made 4th July 2005 Laid before Parliament 6th July 2005 Coming into force 29th July 2005 The Secretary of State, in exercise of the powers conferred upon her by section 153(4) of the Environmental Protection Act 1990, hereby makes the following Order: 1990 c. 43; the relevant functions of the Secretary of State insofar as they relate to Scotland were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46). In relation to Wales, the Secretary of State has concurrent powers with the National Assembly for Wales (see article 2 of, and the entry relating to the Environmental Protection Act 1990 in Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672)).
