Lisa Neubauer is a judge for District II of the Wisconsin Court of Appeals. She assumed office on January 7, 2008. Her current term ends on July 31, 2026.

Neubauer ran for re-election for the District II judge of the Wisconsin Court of Appeals. She won in the general election on April 7, 2020.

In May 2015, Neubauer was appointed chief judge of the court, effective August 1, 2015. She succeeded Judge Richard Brown, who retired.[1] Neubauer served two three-year terms as chief judge from 2015 to 2021.[2]

Education

Neubauer earned her B.S. from the University of Wisconsin-Madison in 1979 and her J.D. with honors from the University of Chicago Law School in 1987.[3]

Neubauer was elected to a full term on the Wisconsin Court of Appeals District II on April 1, 2008. She defeated William Gleisner with 62.6 percent of the vote.[5]

Noteworthy cases

Upskirt conviction affirmed (2015)

At a grocery store on June 26, 2013, Jesse Schmucker attempted to secretly photograph a woman's private areas by taking photos up her skirt, an act known as upskirting. He was arrested and charged with disorderly conduct and attempting to take photos featuring nudity. At trial, Schmucker argued that he could not be convicted on the nudity charge because the woman in the photo was wearing underwear. Schmucker also claimed that a woman assumes a risk that her photo could be taken every time she wears a skirt. Schmucker received a sentence of nine months in prison and appealed his conviction to Wisconsin's Second District Court of Appeals.[6][7][8]

The appellate court affirmed the lower court's judgment, finding that a woman has an expectation of privacy under her skirt even if she is in public.[8] Judge Lisa Neubauer wrote the court's opinion. She wrote,

The facts here were sufficient for the jury to determine that the woman had a reasonable assumption under the circumstances that her pubic area and buttocks were secluded from view, and the photography, of others.[9]

Schmucker's attorney, Jeffrey Jensen, said the court's ruling is a new interpretation of existing law and referenced a 2014 Massachusetts Supreme Court ruling that upskirting was legal under Massachusetts state law.[10][8]

Bid for the federal judiciary

In 2009, Neubauer applied to fill a vacancy on the United States Court of Appeals for the 7th Circuit, along with ten others. The applications were reviewed by a judicial nominating commission, which made recommendations to U.S. Senators Herb Kohl and Russ Feingold.[11] David Hamilton was nominated and confirmed in November 2009.[12]
