Ballot question

The following question appeared on the ballot:[1]

Shall an ordinance amending the General Plan of the City of Cotati to extend the current Urban Growth Boundary for an additional 30 years be adopted?[2]

Impartial analysis

The following impartial analysis of the measure was prepared by the office of the Cotati City Attorney:

This initiative was placed on the ballot by the Cotati City Council, to extend the expiration date of the City’s current Urban Growth Boundary (“UGB”) for 30 years.

In 1998 Cotati voters approved Measure E, an ordinance amending the City’s General Plan to establish a UGB for 20 years. During the life of the UGB, urban development, including sewer and water service extension, is prohibited outside the UGB unless the UGB is amended by a vote of the people or by the City Council pursuant to one of five exceptions set forth in the General Plan. One of the exceptions relates to affordable housing. The UGB will expire in 2018 unless the date is extended by a vote of the people.

In 2015 the City updated its General Plan, incorporated the UGB ordinance provisions into the General Plan’s Land Use Element, and required the Community Development Department to bring to the City Council for consideration a ballot measure to extend the 2018 expiration date.

If approved by a majority of the voters, Measure Q would amend the Land Use Element of the 2015 General Plan to extend the UGB’s expiration date for 30 years, from November 3, 2018 to November 3, 2048, and would make minor text changes to reflect the new expiration date. Measure Q does not change the location of the existing UGB, as depicted in Figure LU 7.2 of the General Plan Land Use Element.

Measure Q would also amend the General Plan Land Use Element criteria for a City Council amendment to the UGB under the affordable housing exception by narrowing the exception to apply only to 100% affordable housing developments, clarifying that the exception applies to housing restricted for occupancy by households earning below 80% of area median income, and adding a sixth criterion requiring the City Council to find that the proposed affordable housing will not result in unmitigated impacts to natural resources, including groundwater basins, natural recharge areas and areas critical to watershed. Measure Q would also add an action item to the Land Use Element of the General Plan requiring the City to review the UGB expiration date with every comprehensive General Plan update and Local Agency Formation Commission (“LAFCO”) Sphere of Influence update.

A “Yes” vote is a vote to amend the Land Use Element of the City’s General Plan as stated. A “No” vote is a vote to permit the UGB to expire in November 2018 and to make no changes to the existing UGB provisions in the 2015 General Plan.
