Muestra: 103 personas adultas mayores de la Asociación Gerontológica Costarricense y 80 privados de libertad del CAI Adulto Mayor. Conclusiones: En la muestra de estudio, la ansiedad ante la muerte está asociada al hecho de que no reciben una atención médica adecuada, situación que los hace más vulnerables a morir en prisión; además de que por su condición de adultos mayores presentan un mayor deterioro físico, el cual aumenta en un ambiente como la prisión, debido a las condiciones a las cuales se ven expuestos.

Since the early 2000s, the proportion of older adults in Japanese penal institutions has risen dramatically, driven largely by high rates of recidivism. This trend has developed alongside growing social insecurity about crime, as well as anxiety about old age and care in a time of increasing neoliberal discourses of individualized risk and responsibility for maintaining health. This article examines the temporal dimensions of these changes and their implications for socially marginalized and criminalized older adults. Starting from Allison's concept of ‘dis-belonging’ (muen) as being out of time with others, I describe how old age inequalities of belonging are produced by chronocratic regimes, and how heterochrony emerges within the contradictions of those regimes. I argue that as old age becomes increasingly subject to chronocratic violence, new rhythms of doing and being time's body are emerging. Drawing on fieldwork in the impoverished area of San'ya, Tokyo, I show how ageing is produced through rhythms of recidivism that entail both agency and possibilities for care. Older men in San'ya see carceral circulation as a way of striving for a good life in what they call ‘shaba’, or the world of suffering and endurance, and a way of making time of ethical potential in old age.

Este estudo analisa as dinâmicas do envelhecimento em contexto prisional, abordando os desafios enfrentados pelas pessoas idosas reclusas e a eficácia de programas sociais destinados a melhorar a sua qualidade de vida. Com base em uma revisão sistemática da literatura, conduzida segundo o protocolo PRISMA e abrangendo 12 estudos publicados entre 2019 e 2024, identificaram-se cinco dimensões centrais: insuficiência de infraestruturas para responder às necessidades desta população, impacto do envelhecimento precoce no ambiente prisional, eficácia limitada dos programas sociais, necessidade de cuidados paliativos e barreiras estruturais e éticas no tratamento de pessoas com demência. Apesar de algumas boas práticas, subsistem lacunas significativas na adaptação de políticas e infraestruturas. Concluise que o envelhecimento em reclusão exige reformas urgentes e integradas, que promovam o envelhecimento digno, a saúde e a reintegração social dos reclusos mais velhos, assegurando o pleno respeito pelos seus direitos humanos fundamentais.

Die Klimakatastrophe, die Vermüllungs- und die Biodiversitätskatastrophe –
auch als Drillingskatastrophe bezeichnet – betreffen Länder und Kulturen des globalen Südens mehr als jene des Nordens, die bekanntlich am meisten dazu beitragen, die Katastrophen verursacht zu haben und die sie weiterhin nahezu ungebremst geschehen lassen. Zeitgenössische Filme beschäftigen sich mit diesem Zusammenhang von Klimakatastrophe und Kolonialismus und zeigen, wie Rassismus und umweltliche Gewalt verbunden sind.

This article is based on a conversation between three people: H.W. and Y.E., French people looking back at their experience of incarceration, and Hannah Davis Taieb, a teacher at the American University of Paris who facilitates classes at La Santé prison on the Walls to Bridges model. Looking back, H.W. and Y.E. recalled not only the emotions felt during incarceration, but the internal work they each did to suppress, hide, dissimulate, or transform those emotions, and the interpersonal work of handling complex emotional challenges with others. The conversation paints two detailed pictures of the emotions evoked by incarceration, and also brings to light the question of strategies for handling or managing emotion, seeking to contribute to recent scholarship that brings out the agency of each social actor in navigating the emotions occurring during incarceration, and to deepen understanding of the transformative process of “emotion work.”

Nel triennio conclusivo degli anni Sessanta del Novecento, in Italia,  molti artisti e artiste decisero di lavorare all’aperto, in strada e nelle piazze – spesso in piccole città o borghi – interagendo e collaborando col pubblico, promuovendo una pratica artistica più accessibile e inclusiva, e rivelando che l’arte contemporanea e la musica non fossero soltanto luoghi abitati da esperti o collezionisti,  ma anche un'opportunità per dar vita ad un “rituale collettivo” e creare un’esperienza pubblica, tra performer e spettatori, più dinamica e partecipativa.

The iconification of political prisoners enhances their visibility, credibility, and power. Nevertheless, iconification may also reduce, reimagine, or otherwise distort the biographies and experiences of political prisoners. Moreover, iconicity’s blurring of prisoners’ views and activities may result in the recirculation of their stories in the service of political projects that do not fully align with their own. The incarceration of the Islamist icon Şule Yüksel Şenler (1938–2019) in 1971 presents an excellent vantage point from which to analyze these dynamics and how gender informs them in fundamental ways. The diverse media representations of Şule Yüksel Şenler demonstrate how historical tropes became entangled with critical references to the law, religion, and the discourses of freedom and democracy in the iconification of an Islamist political prisoner in Cold War Turkey. Şenler’s legacy and the recent references to her story show how the tendency of iconification to occlude or distort prisoners’ ideological investments and activities may in fact enhance their ability to integrate into new political projects. This case study of a right-wing political prisoner exposes how the histories of political incarceration, combined with the discourses of injustice and victimization, may also be used to legitimize authoritarian political regimes and new incarcerations.

This paper considers and critiques two models of moral responsibility: the retributive model, which sees holding-responsible as a retributive or punitive response to a wrongdoer, and the rehabilitative model, which sees holding-responsible as a tool for agency enhancement, moral improvement, or moral scaffolding. I argue that, while responsibility can serve these purposes, it should do so in a way that (also) addresses oppression. I call this view "ameliorative" because it seeks to ameliorate the responsibility system through social justice. In making this argument, I underscore the connections between retribution and rehabilitation in practice (i.e., in the real world) and structural injustice. These connections are too often elided or overlooked in optimistic accounts of responsibility's retributive and rehabilitative potential, in contrast to their bleak reality.

Fonte: Policia Civil do Estado de Roraima Observa-se que nos meses subsequentes de agosto, setembro e outubro os dados de homicídios elevaram, com recorde em setembro com quase 2 ocorrências por dia, totalizando 53 casos. A ruptura nessa dinâmica de violência, deu-se através do declive no mês de novembro que passa de 44 em agosto para 29 ocorrências no mês de novembro, com desfecho de 21 casos no mês de dezembro, sendo que geralmente o referido mês possui mais ocorrência que os meses anteriores, por conta do período comemorativo. Tratando-se especificamente de roubo, fazendo comparativo aos demais anos de 2016 e 2017, no qual o referido crime possui elevação no mês de dezembro, o ano de 2018, observa-se a mesma média de roubos, com meses em destaque sendo janeiro, com 346 casos, o mês de maio, com 417, e junho com 414 casos, e nos mês de dezembro 238 casos, mantendo a média dos meses de menor incidência. Se analisarmos os crimes de furto, latrocínio, roubo com lesão grave e roubo, ocorridos em 2018, podemos afirmar que mês que houve mais furto foi em agosto com 707 registros de ocorrência, reduzindo no mês de novembro para 185 casos e em dezembro com desfecho de 285.

This study delves into the complex issue of parenting behind bars, focusing on the personal narratives of fathers incarcerated for mafia-related crimes in the Catania Bicocca Prison. These fathers participated in an autobiographical project I initiated as part of an ethnographic study on detention. The research begins by offering a comparative analysis of existing literature and projects on parenthood, with a special emphasis on fatherhood in prison settings across the Western world. It highlights the innovative approaches and dynamic research undertaken in Italy over the past decade, which has shown a keen interest in addressing the challenges faced by imprisoned parents. The paper then presents the autobiographical writings produced by the participants during the project. These narratives provide invaluable insights into the struggles and experiences of fatherhood within the confines of prison, shedding light on the emotional and psychological impacts of incarceration on parental roles. By weaving together comparative analysis and firsthand accounts, this study aims to contribute to a deeper understanding of the implications of imprisonment for parental identity and relationships, offering perspectives that challenge conventional views on detention and family dynamics.

This study was conducted to see things as a result of the construction of the correctional system by various regulations currently in the criminal justice system. Changes in the prison terms were later replaced by the term correctional "as if the" confirm that the correctional system is a transformation of the prison system, only talked about the implementation of imprisonment only. Opinion is awakened on penal law as a regulatory juridical penal legitimated conception, only considered limited to the ordinance execute lost independence. The condition is as if "shared" by the penal law only as a correctional construct downstream of a series of law enforcement. This type of research is a normative legal research, so that the study is based on a review of legal norms that underlie the practice of the organization of correctional services. The conclusion of this legal research is that the construction of the penal system is very simple and out of date at this time considered not offset the dynamics of the criminal justice system is growing rapidly. By corollary, the correctional system previously only regulate activities to conduct training which is the final part of the criminal system, with new institutions that took part as subsystems of the penitentiary system, the correctional system should automatically upgrade themselves and define more broadly limits.

Polemik kesetaraan perempuan dan laki-laki selalu menjadi obyek diskriminasi dan ketidakadilan. Pada berbagai dimensi masalah tersebut bertransformasi menjadi pola dominasi yang menimbulkan penindasan dan kesewenang-wenangan dan berujung pada pelanggaran hak perempuan. Sejauh mana kebijakan pemerintah Indonesia mampu menjangkau terhadap isu-isu perlindungan hak perempuan,  terutama bagi mereka yang sedang ditahan atau yang sedang menjalani masa pidana di penjara. Ingatan kolektif yang diskriminatif terhadap perempuan pada masa silam mengingatkan kita bahwa penjara merupakan tempat yang paling rentan terhadap kekerasan yang berbasis gender. Melalui Keputusan Menteri Hukum dan HAM Nomor 17 Tahun 2017 tentang Pembentukan Lembaga Pemasyarakatan Perempuan disetiap Provinsi, negara mengkonfirmasi bahwa pelindungan terhadap hak-hak perempuan yang sedang menjalani pidana tidak dinafikan. Kebijakan ini dianggap sebagai bentuk kebijakan afirmatif karena berkaitan dengan upaya negara dalam memberikan pelindungan hak bagi narapidana perempuan. Tindakan afirmatif merupakan cara yang banyak dipilih oleh negara sebagai jawaban terhadap kondisi sosial yang diskriminatif, adanya ketidaksetaraan dan marginalisasi di segala bidang kehidupan.

This study is conducted to see the things that can be opportunities and challenges of industrial activities implementation in prison. There are many challenges faced by organization of industrial activities in prison which underlying it's activity. The principle of economy for industrial activity will cause worries of a clash with the correctional principle, which is as a place with more emphasis in order to enhancing inmate's capacity. There are also suspicions of this practices as a exploitation or a new form of slavery as we know from correctional philosophy in Indonesia, that mentioned hostile of capitalist system principle that abandon social welfare aspects. Assuming that prison principle can be integrated with efficient management, industrial activities in prison could not be an impossible idea. As a fundamentally, industrial activities in prison from any perspective such as philosopical aspects, juridical aspects, sociological aspects, historical aspects as well as theoretical aspects are very possible. This day, Potential possessed by prisons to organize the industry cannot be underestimated. Amount of labor and power of prison products market share might be "preliminary capital" and determinant factor to encourage industrial activities in prison during domestic and foreign trade competition. Condition of industrial activities in prison had through a long journey with any fluctuation. It becoming additional capital for each prison to manage their own industry, because they already have so many comprehensive experiences so they do not have to start from the scratch then they are able to determining future policy directions. The existence of industrial activities in prison are also inseparable from paradigm alteration that prison is a place with more serious transformation of imprisonment as an effort to protect the community by reducing elements of crime through giving "provision of live" for inmates in order to reintegrate into social community. Giving "provision of life" is representation of industry activities in prison as response to the demand of current social dynamics. This research uses normative research, that based on the review of legal documents and legal norms that underlied for prison's administration. The conclusion is about implementation of industry in prison as a necessity that must be taken by government seriously. Industrial activities in prison giving impacts and benefits also to the country and correctional institution especially. Furthermore, foster the public confidence to the correctional function, with assumption of the prisoners that going to be highly productive, so they will have higher chance for reinstated into society. This contribution have direct intention to achieve social reintegration goals.

Research exploring the association between youth offending and education has largely focused on youth under the age of 18. Little previous research has examined the experiences of frontline staff working with children and young people (CYP) in the broad age range of 10 – 25 years old, that offend. What research there has been has tended to focus on the effects of imprisonment on CYP’s education with limited research on the educational needs of those subject to community-based sentences. This study aimed to elicit the views of the Youth Offending Service (YOS), National Probation Service (NPS) and Further Education (FE) college practitioners on appropriate interventions to support the special educational needs and disabilities (SEND) of young people and young adults (YPA) subject to community-based sentences. This document presents the Strategic Plan for the California State University Project Rebound Consortium for the years during which the initiative was lead and overseen by Cal State University Fullerton (2019-2023). Developed collaboratively and endorsed by CSU leadership, this plan outlines the history, mission, vision, values, and goals of Project Rebound, aiming to establish a publicly funded network of campus-based programs across the CSU system. It serves as a guide and rubric for current and aspiring member campuses, emphasizing a common mission, shared values, and programmatic standards.

The plan highlights the need for such a program due to the high incarceration rate and the barriers faced by formerly incarcerated individuals in accessing higher education, despite their potential to enrich university communities. Project Rebound's history, originating in 1967 at San Francisco State University, and its expansion into a consortium in 2016 are detailed, noting its impressive outcomes such as a high GPA and low recidivism rate.

The core of the plan lies in its articulation of the mission to support reintegration through education and mentorship, the vision of equitable access, and guiding values that prioritize the intrinsic worth of individuals and the transformative power of education. It further specifies Key Service Objectives focused on outreach, enrollment support, student persistence, engagement, and alumni networking and Key Program Elements defining the structure and essential components of campus programs, including staffing, physical locations, and partnerships. The plan concludes with five strategic goals centered on growing and improving the consortium, expanding to new campuses, strengthening student success, engaging in public education and advocacy, and conducting rigorous research and evaluation.

The 2021 Annual Report of the California State University Project Rebound Consortium highlights the program's ongoing commitment to supporting the higher education and successful reintegration of formerly incarcerated individuals across its 14 member campuses. Despite the unprecedented challenges of the global pandemic, Project Rebound demonstrated remarkable resilience with a 93% second-year persistence rate for Fall 2019 entrants, exceeding the CSU overall. By Spring 2021, the Consortium anticipated conferring 184 Bachelor's and Master's degrees.

The report emphasizes that Rebound Scholars are a diverse and resilient student population, largely from historically marginalized backgrounds, with 61% identifying as Black, Latino, or Native American, and 69% being Pell Grant recipients. Key program elements focus on advancing equitable access, cultivating cultures of belonging, and establishing infrastructures of care to meet students' basic needs. The report details initiatives in outreach, advising, peer support, housing, and employment.

A significant achievement is the 0% recidivism rate for Project Rebound students between 2016-2020, compared to 46% for the state of California. The report also outlines the Consortium's administrative and governance structure, its expansion plan to five additional CSU campuses, and its efforts in systemwide learning and innovative initiatives.

The 2022 annual report of the California State University Project Rebound Consortium highlights its continued success in providing equitable access to higher education for currently and formerly incarcerated individuals. Since 2016, Project Rebound has evolved into a consortium of 14 CSU campus programs. Despite pandemic-related challenges, Project Rebound nearly doubled its enrollment in the past year, with 150 graduates in the Class of 2022, bringing the total number of conferred degrees since the consortium's formation in 2016 to 500.

The report also details the program's collaborations with other CSU entities and external organizations.

From 2016 to 2023, the Project Rebound Consortium expanded from a single campus program to a consortium encompassing 15 CSU campuses. Between 2022 and 2023, systemwide enrollment nearly doubled, with a graduating class of 247 in 2023, bringing the total number of bachelors and masters degrees conferred to 749 since 2016. The program boasts a consistent recidivism rate of less than one percent. With ongoing state funding, Project Rebound continues to expand to additional CSU campuses.

The 2024 annual report for Project Rebound at California State University, Fullerton highlights the program's vital role in making higher education accessible and supportive for formerly incarcerated students. Project Rebound aims to empower these students to acquire knowledge and skills, enhance civic engagement, secure employment, and ultimately contribute to safer communities. The program's mission is achieved through mentorship and the living examples of formerly incarcerated students, graduates, faculty, and staff.

The report details Project Rebound's second chance admissions policy, its transformative housing initiative, basic needs support, mentorship, and the Dare 2 Dream juvenile justice program. Rebound Scholars are a diverse group, with a majority being Black or Latino, older than traditional students, and often first-generation college students.

The program boasts impressive outcomes, including a high academic standing (94%) and a low recidivism rate of just 3% compared to California's 42%. Since 2016, CSU Fullerton has conferred 222 bachelor’s and master’s degrees to Rebound Scholars. The report underscores Project Rebound's significant impact on students, their families, and the broader community by disrupting cycles of poverty and incarceration.

El estudio aborda la crisis espacio-funcional
de las cárceles del Ecuador, haciendo énfasis en el
Centro de Privación de Libertad de Tungurahua, en un
contexto marcado por la sobrepoblación, el hacinamiento
y condiciones de habitabilidad deficientes. Meditante una
metodología cualitativa, se explora el emplazamiento, el
programa arquitectónico, las relaciones espaciales, y las
condiciones ambientales dentro del centro penitenciario,
y cómo estas inciden en el proceso de rehabilitación
y reinserción de las personas privadas de libertad a la
sociedad. Los hallazgos indican deficiencias críticas en la
configuración espacio-funcional del Centro de Privación
de Libertad de Tungurahua, las cuales contribuyen a un
entorno carcelario perjudicial, exacerbando problemas como
el deterioro del bienestar físico y psicológico de las personas
privadas de libertad. Finalmente, la investigación subraya
la necesidad de un replanteamiento en el diseño de estos
espacios para fomentar efectivamente la rehabilitación y la
reinserción social de los reclusos.

La prisión, a diferencia de otros ámbitos de la vida social, no regula sus relaciones por la búsqueda de la legitimidad o el establecimiento de un poder positivo, sino que lo hace a través del recurso a instrumentos de coerción o violencia que producen el temor como principal forma de gobierno. Partiendo de esta idea, estudio la visita a prisión como un proceso moldeado por la violencia de su estructura, pero también como un proceso que permite revelar su violencia en otros ámbitos. La visita es por lo tanto un eslabón en la cadena de violencias carcelarias y un reflejo ampliado de su violencia. Como eslabón, nos permite atender al control que ejerce sobre los familiares en el ingreso y el control de las comunicaciones; como espejo, apunta a cómo se extiende el daño hacia los familiares a partir del relato del detenido, en las marcas sobre el cuerpo del penado o en el miedo a la cárcel que se difunde entre la familia a través de las comunicaciones. Así, a partir del relato de la visita de un conjunto de parientes de personas presas, apunto algunas claves sobre cómo la violencia de la prisión es vivida en el entorno familiar y cómo podemos pensar la familia en el entorno penitenciario.

This chapter analyzes the evolution of the prison order which the pangkat society, or the society that inmate gangs collectively constitute, at the Maximum Security Compound (Maximum Bilibid) of the New Bilibid Prison (NBP) in the past several decades until 2016. It argues that the inmates’ level of isolation from the outside world impacted the transformation of prison social order and the quality of self-governance practiced by the inmates. he chapter follows through the burgeoning interest in inmate governance across the globe and, based on the Philippine experience, for future studies to factor in a historical evaluation of the phenomenon and the impact of visiting policies, civil society groups, and other elements that link the incarcerated population to the outside world.

Filling a gap in knowledge in gender theory, genocidal, and Holocaust studies, this paper operationalizes the concept of phallicism as an analytic explanation of the simultaneous killing and sexual victimization of racialized men in western, capitalist, patriarchal societies. The theory of phallicism posits that racialization lays the basis for a sexualization process wherein racialized males are caricaturized as both salacious savages (who can be raped by the men or women of the dominant racial group) and bestial/wanton creatures deserving of immediate death for the sake of liberal civility. Breaking with the dominant interpretive lenses in scholarly discourses around race and gender that understand racialized femininity as the basis of dehumanization, this paper will operationalize the notion of phallicism through historical and comparative analysis of the writings of political prisoner George Jackson and Primo Levi, a survivor of the Jewish Holocaust. With the theory of phallicismthe guiding theoretic of the paradigm of Black Male Studies-we can sharpen our conceptual acumen to account for the function of misandric patterns of intergroup violence and its role as the organizing principle of the negrophobia characteristic of Western, patriarchal, capitalist regimes.

Prison architecture transcends mere walls and bars; it embodies societal values. As Michel Foucault observes, “Work must be done on the soul of the incarcerated, as frequently as possible. The prison, as an administrative apparatus, must simultaneously function as a machine for reforming minds” (Discipline and Punish: The Birth of the Prison, Einaudi, Turin, 1993, p. 137). This transformation may manifest as sterile punishment or active rehabilitation, contingent on design choices. With overcrowding affecting 30% of European nations (Council of Europe, 2022) and alarmingly high recidivism rates in many contexts, reimagining detention spaces emerges as an ethical and social imperative.
This study examines two antithetical models—Bollate Prison (Italy) and Witzwil Penitentiary (Switzerland)—to demonstrate that balancing security with human dignity is feasible and constitutes an investment in social cohesion.

The cultural history of the ‘Black Atlantic’ and the African diaspora as a “modern political and cultural formation” cannot be adequately understood without reference to the transatlantic slave trade and colonial conquest. 1 Blackness and the ideology of white supremacy are legacies of European colonialism and its plunder and pillaging of Africa and other continents. ‘Race’, in this sense, is not extrinsic to capitalist modernity or simply the product of specific historical formations such as Jim Crow America (c. 1883-1965) or South African apartheid (c. 1948-1994). Likewise, capitalism does not simply incorporate racial domination as an incidental part of its operations, but from its origins “systematically begins producing and reproducing ‘race’ as global surplus humanity”.

This article connects a fundamental theological reflection on the nature of belief to the work of prison chaplains and the quest for a humane response to crime. An analysis of the act of faith as described in the work of John Henry Newman reveals the paradoxical nature of what it means to believe someone. Faith in persons is fundamentally dogmatic and not primarily a response to persons' characteristics or to the content of their words. This insight clarifies two key features of prison chaplaincy: fundamental trust in people in prison and the radical Rahnerian conviction that Christ is encountered in people in prison. An understanding of the paradoxical nature of belief in persons also sheds light on society's attempt to rehabilitate offenders. With the aid of Hannah Arendt, a concept of rehabilitation is developed that aims at reaffirming offenders as trustworthy citizens. Against recent claims by Martha Nussbaum, it is argued that a trust-oriented approach to offenders must also involve retributive punishment. The article concludes by recapturing the arguments on faith, prison chaplaincy, rehabilitation and punishment using the concept of symbolic encounter.

A complexidade da questão criminal tem se intensificado nos últimos anos, com o crescimento das organizações criminosas e a diversificação de suas atividades para além dos mercados ilegais tradicionais. Além do tráfico de drogas e armas, observa-se um aumento expressivo nos roubos e furtos praticados dentro de redes criminosas estruturadas, delitos praticados pela internet e negócios envolvendo postos de gasolina e outros nichos para a lavagem de dinheiro obtido nos mercados ilegais, como demonstrou a recente pesquisa publicada pelo FBSP, Follow the products: rastreamento de produtos e enfrentamento ao crime organizado no Brasil.

Essas dinâmicas impõem novos desafios aos gestores da segurança pública, bem como aos policiais civis e militares e aos membros do Poder Judiciário, que precisam encontrar formas de responder ao medo e à insegurança da população e ao poderio criminal dessas organizações sem comprometer os princípios do devido processo legal e os direitos e garantias fundamentais dos acusados. Nesse sentido, políticas que busquem equilibrar repressão qualificada com ações voltadas à prevenção e reinserção social tornam-se essenciais para a construção de um modelo de segurança mais eficaz e sustentável.

Diante desse cenário, propomos um redirecionamento das políticas públicas sobre drogas no Brasil com base em cinco pilares principais.

Este trabalho tem o objetivo de investigar como a fase de orientação do ciclo de inteligência é conduzida
pelos Batalhões de Área da Polícia Militar do Estado do Rio Grande do Norte. Foram feitas entrevistas
com comandantes de Batalhão e chefes das agências de inteligência, para se ter um panorama de como
é feita a direção e o planejamento de inteligência voltados ao enfrentamento das facções prisionais. A
atividade de Inteligência de Segurança Pública (ISP) é dotada de doutrina própria, na qual se indica que o
processo de produção de conhecimento deve seguir um ciclo composto de três fases. A primeira dessas
fases é a orientação, na qual se definem as diretrizes e o planejamento da atividade. Conclui-se que a
fase de orientação é pautada, essencialmente, por demandas verbais pontuais sem vínculos com políticas
de governo ou institucionais, bem como que não são utilizados planos de inteligência para delimitar o
processo de produção de conhecimento sobre as organizações criminosas de base prisional atuantes nas
áreas dos comandantes e chefes entrevistados.

Presenting the material experiences of currently and formerly incarcerated
people, this special issue helps to map the feeling and display rules that
constitute the emotion culture(s) of different carceral spaces. This work also entails considering the affective experience – a ‘felt’ geography (Davidson & Milligan, 2004), for example, where the confined body acts as a canvas for the inscription of identity, social relations, and experience (Moran, 2012a, 2012b), such as when the scars from self-harm act as a visible signifier of emotion (Kilty, 2012a, 2012b). In this way, “law [and the prison] ‘takes hold of’ bodies in order to make them its text” (de Certeau, 1984, p. 139). Space also shapes how time is experienced (Lefebvre, 1991). As prison exhibits a ‘drudgery of place’ (Urry, 2014) where time stagnates, prisoners often feel suspended in time, increasing their feelings of detachment and loneliness (Guenther, 2013; Martel, 2006; Moran, 2012b; Stoller, 2003). Studying how emotions shape the organization and management of carceral spaces and how carceral spaces shape feelings and emotions contributes to rethinking the affective politics of these environments.

Peter Collins' memorial was held on the warm fall evening of September 15, 2015, at the Quebec Public Interest Research Group (QPIRG) Concordia, a Montreal-based organization that supports grassroots student and community organizing. I knew about Peter from Fly in the Ointment (2015), a video he made about his experiences with solitary confinement that had been posted online and shared many times. The QPIRG space was full; friends, family, and peers sat in front of floor-to-ceiling windows overlooking downtown streets. Projections of Peter's drawings and paintings looped on a portable screen, and his original artworks were propped up on easels and pinned to the wall. Veggie platters and cookies surrounded sugar packets and mugs. I listened as people in the room did a heartfelt, tearful go-around about the influence of "Pete" on their lives. In all their stories, I heard a sense of anger about the prison conditions under which he had died. As an artist making work behind bars, Peter highlighted through his pieces the grave injustices committed by Correctional Service Canada (CSC); these works, in turn, diminished his chances for parole and release. Born on August 22, 1961, in England, Peter moved with his family to Ottawa in 1967. They describe him as a curious, kind, and intelligent kid-particularly fond of animals, who were drawn to his quiet nature. Things became difficult at home and school, and Peter left his family

This article examines the quality of work of religious organizations in places of deprivation of liberty, as well as their interaction with the penitentiary service of Ukraine. It was revealed that the chaplaincy ministry occupies an important place in the Christian churches of Ukraine. In the early 1990s, ministry in Ukrainian prisons was allowed, but most of the churches were at the stage of survival, so they were not able to carry out active work in prisons. At the legislative level, prisoners have ensured freedom of religion, and the penitentiary service was obliged to provide access to representatives of each of the churches of Ukraine. In fact, in most cases, priests of the Orthodox Church have access to prisons. In 2012, the optimization of the legal framework of cooperation between state bodies and the Ukrainian Orthodox Church of the Moscow Patriarchate was devoted to a round table whose participants were the deputies and members of the All-Ukrainian Council of Churches and Religious Organizations. The main requirements for prison chaplains are considered, following which chaplains must be prepared for irregular schedules and all kinds of unexpected difficult situations. Protestant service to convicts is carried out to create correctional institutions and local communities appropriate for the rehabilitation of convicts. The evangelical ministry of Protestant chaplains is especially distinguished for the prevention of suicides since clergymen help convicts in overcoming depression and hopelessness. It has been proven that prisoners who agree to undergo a rehabilitation program with chaplains are less likely to return to their previous lifestyle. The rehabilitation course takes place after release when the chaplain helps the person to socialize. Chaplains also pay attention to spiritual and educational work among the staff of correctional colonies. According to statistical data, 90% of convicts who have completed a rehabilitation course do not return to the colony. Thus, the service of prison chaplains can be perceived as one of the levers of state security, which contributes to the proper moral and psychological level of society and the complete rehabilitation of convicts.

Trata-se da análise das motivações nas decisões judiciais nos crimes de roubo no Rio Grande do Sul. Trabalha-se com a amostra inicial de quarenta e oito processos, dos quais serão comparados acórdãos e sentenças. As decisões foram recolhidas em duas etapas: primeiro pesquisou-se aleatoriamente quarenta e oito acórdãos, dos anos de 2002 e 2004; de modo contínuo, foram averiguadas as sentenças correspondentes. Tendo iniciado a pesquisa pelo Tribunal de Justiça e sabendo que são quatro Câmaras Criminais que julgam processos de roubo, este número inicial corresponde a três processos por desembargador/relator de cada Câmara. Da comparação entre sentenças e acórdãos pode-se obter, perspectivamente, uma significação do imaginário dos magistrados. Primando pela averiguação qualitativa, pretende-se interpretar a resposta dos magistrados à pergunta do "porque punir?". A partir destes dados crê-se possível questionar o projeto jurídico-penal enquanto mantenedor da memória do delito e fundado nas noções de 'culpa moral' e 'sentimento de dever', cuja conseqüência tem sido a potencialização da violência. Daí dizer que esta pesquisa insere-se na crítica do discurso punitivo pautado pelo 'delírio de grandeza', decorrente da autoatribuição do papel de proteção dos valores mais caros à Humanidade. Este discurso penal, calcado na concepção científica de 'vontade de verdade', inscreve-se numa espécie de 'narcisismo infantil', cuja onipotência incapacita a percepção dos seus próprios limites, ofuscando reais possibilidades de controle das condutas lesivas. A partir da percepção da complexidade do fenômeno analisado, quer-se produzir uma chave de leitura que ensaie a possibilidade de construir um discurso que paute a ação dos procedimentos penais na perspectiva da minimização da dor (violências), isto é, uma política de redução de danos penais. Permasalahan tafsir pemberian hak tunjangan kinerja bagi PNS wanita yang melaksanakan cuti melahirkan di Kementerian Hukum dan HAM menjadi penting untuk diteliti karena menunjukkan suatu ketidakadilan yang bersifat imateril berupa pemotongan hak cuti melahirkan dan materil yakni adanya pemotongan hak tunjangan kinerja.
Penelitian ini bertujuan untuk mengetahui dan menganalisis tafsir Pasal 21 b Permenkumham No. 33 Tahun 2017 yang mengatur tentang pemberian hak tunjangan kinerja bagi pegawai negeri sipil wanita yang melaksanakan cuti melahirkan untuk kelahiran anak ketiga di Kementerian Hukum dan Hak Asasi Manusia Nusa Tenggara Timur, serta mengajukan tafsir yang ideal dari aspek gramatikal.
Metode penelitian yang digunakan yakni penelitian hukum normatif. Permasalahan tafsir pemberian hak tunjangan kinerja kaitanya dengan pemberian hak cuti melahirkan diinterpertasikan secara normatif menggunakan metode penafsiran hukum dan diuraikan secara sistematis dalam kategori Hukum Tata Negara.
Hasil penelitian menunjukkan bahwa: 1)Tafsir pemberian hak tunjangan kinerja bagi pegawai negeri sipil wanita yang melaksanakan cuti melahirkan untuk kelahiran anak ketiga di Kementerian Hukum dan Hak Asasi Manusia Nusa Tenggara Timur dilakukan pelaksana aturan bersifat subyektif dan parsial sejalan dengan Permenkumham No. 33 Tahun 2017 tentang Pelaksanaan Pemberian Tunjangan Kinerja Bagi Menteri dan Pegawai di Lingkungan Kementerian Hukum dan Hak Asasi Manusia. Secara gramatikal, redaksi rumusan Pasal 21 b Permenkumham Nomor 33 Tahun 2017 perlu direvisi selaras dengan rumusan Bagian D angka (1) Peraturan Badan Kepegawaian Negara Republik Indonesia Nomor 24 Tahun 2017 tentang Tata Cara Pemberian Cuti Pegawai Negeri Sipil dan rumusan Pasal 325 ayat (1) Pemerintah Nomor 11 Tahun 2017 tentang Manajemen Pegawai Negeri Sipil. Kemudian perlu dilengkapi Pasal penjelasan agar pelaksana aturan tidak menafsirkan secara subyektif.

Pengaturan hak Pegawai Negeri Sipil (PNS) Wanita di Kementerian Hukum dan HAM menjadi penting mengingat Kementerian Hukum dan HAM merupakan lembaga Negara yang secara spesifik menangani permasalahan hukum dan hak asasi manusia. Tujuan hukum untuk mensejahterakan manusia dengan melindungi hak adalah wujud otoritas kehadiran hukum melalui Kementerian Hukum dan HAM. Kehadiran hukum dalam wujud Peraturan Menteri Hukum dan HAM tentang Pemberian Tunjangan Kinerja bagi PNS wanita yang melaksanakan hak cuti melahirkan diatur dalam Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 33 Tahun 2017 tentang Pelaksanaan Pemberian Tunjangan Kinerja Bagi Menteri dan Pegawai di Lingkungan Kementerian Hukum dan Hak Asasi Manusia, memuat ketentuan pembayaran tunjangan kinerja bagi PNS wanita yang melaksanakan cuti melahirkan yang secara substansial dan teknis belum mengatur pemberian tunjangan kinerja bagi PNS wanita yang tidak diberikan hak cuti melahirkan dan pemberian tunjangan kinerja bagi PNS wanita yang hanya menjalankan satu kali hak cuti melahirkan karena sebelumnya telah memiliki dua orang anak. Tujuan Penelitian ini untuk mengetahui dan menganalisis pengaturan pemberian hak tunjangan kinerja bagi PNS wanita yang melaksanakan hak cuti melahirkan pertama, dimana wanita tersebut sebelum berstatus PNS telah memiliki dua anak dan pemberian hak tunjangan kinerja bagi PNS wanita yang tidak mendapatkan hak cuti melahirkan pertama, untuk kelahiran anak ketiga. Metode penelitian ini yakni yuridis normatif, mengkaji asas hukum, sistematika dan taraf singkronisasi berbagai perangkat hukum terkait Aparatur Sipil Negara (ASN), Kepegawaian, Perkawinan, dan Hak Asasi Manusia. Penelitian ini juga merupakan jenis penelitian empiris yakni melihat bekerjanya hukum dalam pelaksanaan pemberian hak cuti melahirkan dan hak tunjangan kinerja. Permasalahan pemberian hak cuti melahirkan kaitanya dengan pemberian hak tunjangan kinerja diinterpertasikan menggunakan interpretasi hukum normatif dan menguraikan secara sistematis dalam kategori Hukum Tata Negara. Hasil penelitian ini menunjukkan bahwa belum ada pengaturan pemberian hak tunjangan kinerja bagi PNS Wanita yang melaksanakan hak cuti melahirkan pertama, dimana PNS wanita tersebut sebelum berstatus PNS telah memiliki dua anak dan pengaturan pemberian hak tunjangan kinerja bagi PNS Wanita yang tidak mendapatkan hak cuti melahirkan pertama, untuk kelahiran anak ketiga. Secara ketatanegaraan negara Indonesia adalah negara hukum, maka negara berkewajiban melindungi hak PNS wanita karena merupakan hak kodrati. Oleh karena itu, perlu ditinjau kembali Norma dan Materi Muatan Peraturan Menteri Hukum dan Hak Asasi Manusia Republik Indonesia Nomor 33 Tahun 2017 tentang Pelaksanaan Pemberian Tunjangan Kinerja Bagi Menteri dan Pegawai di Lingkungan Kementerian Hukum dan Hak Asasi Manusia. Secara afirmatif wajib mencantumkan norma Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia karena memuat materi melahirkan yang secara kodrati melekat pada PNS Wanita (human right).

Η παρούσα ανακοίνωση επιλαμβάνεται θέματα τα οποία έτυχαν ιδιαίτερης ενασχόλησης από τον τιμώμενο εκλιπόντα Ομότιμο Καθηγητή Εγκληματολογίας Ιάκωβο Φαρσεδάκη. Ειδικότερα εμπεριέχει μια συνοπτική περιγραφή των επιβαλλόμενων κύριων αλλά και παρεπόμενων ποινών κατά το αρχαίο ελληνικό δίκαιο, με ιδιαίτερη αναφορά στην ποινική αντιμετώπιση της ανθρωποκτονίας, στην επιβολή ειδικότερα της ποινής της ατιμίας και της αποστέρησης των πολιτικών δικαιωμάτων του δράστη, αλλά και στην ιδέα της επανορθωτικής δικαιοσύνης και την εφαρμογή της στα πρότυπα διαμεσολάβησης και διαιτησίας της εποχής. Περαιτέρω, περιλαμβάνεται μια ευσύνοπτη αναφορά τόσο στη νομοθεσία του Σόλωνα, με την οποία η πόλις καθίσταται ως η μόνη αρμόδια για την αντιμετώπιση του εγκλήματος, με ιδιαίτερη αναφορά στην καινοτόμο εισαγωγή της χρηματικής ποινής για ορισμένα αδικήματα, όσο και στην πλατωνική ποινική σκέψη και την ανάδειξη του διττού σκοπού της ποινής, ζητήματα καταλυτικά στην αναγνώριση της υπεροχής του δημοσίου συμφέροντος στην επιβολή των κυρώσεων από την οργανωμένη Πολιτεία και τον τερματισμό της ιδιωτικής εκδίκησης. Τέλος, η έννοια του εγκλήματος, ο χαρακτήρας των αποφάσεων των δικαστηρίων της εποχής αλλά και ο σκοπός της επιβαλλόμενης ποινής στην Αθηναϊκή Δημοκρατία αποτελούν διακριτά μέρη της εισήγησης, με ιδιαίτερη αναφορά στον στόχο της επανακοινωνικοποίησης του εγκληματία, όπως αυτή συναντάται στην αρχαία ελληνική γραμματεία.

For the Ecological School of Chicago, there are «natural
areas» for human life equivalent to those of animals or
plants, and the city, as an organic whole, is their «nat
ural habitat». Starting from Chicago, the well-known
model of five concentric zones, on which the research
approach to juvenile delinquency was subsequently
based, was extended to many American cities, conclud
ing that there are areas in the city where crime devel
ops in the form of a «social tradition», inseparable from
the life of the local community. Despite the criticism,
this research was a pilot for those that followed, as well
as the basis for the implementation of the first commu
nity prevention program (Chicago Area Project).
